These Terms of Service (“Terms”) govern the use of the website www.brandmaratha.store (“Platform”), operated by Brand Maratha Studio Pvt. Ltd., having its registered operations in Mumbai, Maharashtra, India (“Brand Maratha”, “we”, “us”, “our”).

By accessing, browsing, or using this Platform, whether as a customer or a seller, you agree to be bound by these Terms.

1. Platform Overview

Brand Maratha is a multi-vendor e-commerce marketplace that enables independent brands, designers, and vendors (“Sellers”) to list and sell their products to customers (“Users” / “Customers”) through our Platform.

Brand Maratha acts as a facilitator and marketplace intermediary and does not manufacture products unless explicitly stated.

2. Eligibility

• Users must be 18 years or older to transact.
• Sellers must be legally eligible to sell products under Indian law.
• By using the Platform, you represent that all information provided by you is true and accurate.

3. User Accounts

• Users may be required to create an account to place orders.
• You are responsible for maintaining the confidentiality of your account credentials.
• Brand Maratha is not liable for any loss arising from unauthorized account access.

4. Products & Listings

• Product details, pricing, images, and descriptions are provided by Sellers.
• Brand Maratha uploads seller-provided content on their behalf based on information received via forms or other means.
• While we strive for accuracy, Brand Maratha does not guarantee that product descriptions are error-free.

5. Pricing & Payments

• All prices are listed in Indian Rupees (INR) unless stated otherwise.
• Payment modes accepted include UPI and debit/credit cards.
• Payments are processed through third-party payment gateways.
• Brand Maratha is not responsible for payment gateway failures or delays.

6. Shipping & Delivery

• Shipping and logistics are managed by Brand Maratha logistics partners.
• Delivery timelines are estimates and may vary due to operational or external factors.
• Risk of loss transfers to the customer upon delivery.

7. Returns, Refunds & Cancellations (Customers)

• Returns are allowed within 2 days from the date of delivery, only on eligible products.
• Customers must provide a clear unboxing video as evidence in case of damaged or defective products.
• Refunds are processed by Brand Maratha, after verification.
• Refund timelines may vary based on payment method and investigation outcome.
• Products damaged due to misuse, negligence, or customer handling may not be eligible for returns.

8. Seller Onboarding & Obligations

Sellers onboarded on Brand Maratha agree to:

• Provide valid GST registration and certificate
• Provide accurate product details and pricing
• Accept returns on eligible products
• Comply with applicable Indian laws and regulations
• Ensure products are authentic and legally sellable

9. Intellectual Property (IP) Rights

a) Seller Content

• Sellers retain ownership of their product images, videos, and descriptions.
• Sellers grant Brand Maratha a royalty-free, non-exclusive, worldwide license to use, modify, adapt, and publish this content for marketing, promotional, and platform-related purposes.

b) Brand Maratha Content

• All original content created by Brand Maratha (logos, creatives, videos, text, campaigns) remains the exclusive intellectual property of Brand Maratha Studio Pvt. Ltd.

10. Marketing & Promotion

Brand Maratha may:

• Feature seller brands/products on social media, ads, or promotional materials
• Edit or aesthetically modify product creatives for marketing
• Use seller brand names and images without additional permission

11. Liability & Product Responsibility

• Sellers are primarily responsible for manufacturing defects or incorrect products.
• Logistics-related damage will be assessed based on evidence.
• Customer-caused damage is not eligible for return/refund.
• Brand Maratha’s role is limited to facilitating resolution and refunds where applicable.

Brand Maratha shall not be liable for indirect, incidental, or consequential damages.

14. Limitation of Liability

To the maximum extent permitted by law:

• Brand Maratha’s total liability shall not exceed the value of the product purchased.
• We are not liable for seller actions, customer misuse, or third-party service failures.

15. Suspension, Removal & Termination

Brand Maratha reserves the right to:

• Remove product listings
• Suspend or terminate seller or user accounts
• Take action without prior notice

Such actions may occur due to suspected misconduct, legal risk, misuse of the platform, or violation of evolving platform policies.

16. Policy Updates

Brand Maratha may update these Terms from time to time.
Continued use of the Platform implies acceptance of revised Terms.

17. Dispute Resolution

• Any disputes shall first be resolved through arbitration.
• Arbitration shall be conducted in Mumbai, under Indian law.
• Courts at Mumbai shall have exclusive jurisdiction.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.
